MyLittleHolding is an non-profit organization that aims to support the development of entrepreneurial projects, side-businesses and start-ups, from the ideation to the Early-Stage.

Article 11: Legal nature

The organization MyLittleHolding is a non-profit organization, this one is exempt from VAT following the exemption of commercial taxes through its two conditions:

– The management is disinterested

– Non-profit-making activities are predominant – with income from profit-making activities not exceeding € 72,000 (threshold 2020; threshold 2019 = € 63,059).

The disinterested nature of the management is assessed according to the usual criteria of the three-step approach adopted by the tax authorities to determine whether or not an association is profitable, i.e. mainly voluntary management and administration and the absence of direct or indirect distribution of profits.

As for the preponderance of non-profit activities, it is understood “in the manner that best reflects the real weight of the association’s non-profit activity”, compared to a multi-year average. This may be the accounting criterion or any other criterion with regard to the operation of the association.

Finally, the threshold of €72,000 (threshold 2020; threshold 2019 = €63,059) is assessed in relation to all the operating income received from the association’s profit-making activities during the calendar year (not by reference to an accounting year) and is understood without VAT.

Article 12: Applicable Law and Jurisdiction

This contract is subject to International law. The contract has priority over French law. In case of unresolved dispute between the User and the Publisher, the courts of Paris, France are competent to settle the dispute.
